The court ruled that Comandclem could not claim royalties as per the 1980 agreement with Mobil. However, since comandclem got the patent right in 1999, the inventor has the right to claim royalties from 1999 upwards. Hence, comandclem asked mobil to pay a new rate of $10 per barrel from 1999 to 2020, when the patent right will expire.
